Agreement to these terms
These Terms of Service ("Terms") form a contract between you and inksby ("we," "us"). They cover your use of inksby.com, our apps, and every order you place. By creating an account or placing an order you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use inksby.
Who can use inksby
You must be at least 18, or the age of majority where you live, to place an order. If you buy on behalf of a business, you promise you are authorized to bind that business. You agree to use inksby only for lawful purposes and in line with these Terms.
Your account
You are responsible for the accuracy of your account details and for keeping your password safe. Everything that happens under your account is your responsibility. Tell us right away at help@inksby.com if you suspect unauthorized use.
Orders, pricing & payment
Placing an order — submitting an order is an offer to buy. Your order is accepted, and a contract forms, when we send you an order confirmation.
Prices — prices appear at checkout in U.S. dollars and may change over time; the price you pay is the one confirmed at checkout, plus any applicable tax and shipping.
Payment — you authorize us to charge your chosen payment method for the full order total. We may cancel or refuse orders due to pricing errors, suspected fraud, or supply issues, and will refund anything already charged.
Proofing — you are responsible for reviewing your crop, size, spelling, and layout before ordering. We print exactly what you approve.
Shipping, returns & our guarantee
We print to order and ship as fast as we responsibly can; delivery dates are estimates, not guarantees, and risk of loss passes to you on delivery. Because every item is personalized to your photos, we do not accept general returns — but we stand behind our work. If your order arrives damaged, defective, or not as described, contact us within 30 days and we will reprint or refund it. That is our happiness guarantee.
Your photos and the license you grant
You keep all rights to the photos and content you upload. We do not claim ownership of your images.
To make your order, you grant inksby a limited, non-exclusive, worldwide, royalty-free license to store, reproduce, and adapt your content — for example, to crop, color-correct, and resize it — solely to produce, fulfill, and support the order you place, and for nothing else. This license ends when your files are purged after fulfillment. We will not use your photos in our marketing unless you give us separate, explicit permission.
You promise that you own or have permission to print everything you upload, that it does not infringe anyone else’s copyright, trademark, publicity, or privacy rights, and that you will reimburse us for claims arising from content you had no right to print.
Content you may not print
You agree not to upload or order anything that:
infringes someone else’s intellectual-property or privacy rights;
is unlawful, defamatory, hateful, or harassing;
sexually exploits or abuses a minor, in any form, ever;
promotes violence or illegal activity.
We may refuse, cancel, or remove any order or content that violates these rules or the law, and we may report unlawful content to the authorities.
Our intellectual property
The inksby name, logo, website, product designs, photography, and software are owned by inksby and protected by law. We grant you a personal, non-transferable, revocable license to use the site to browse and place orders — nothing here transfers our intellectual property to you.
Third-party services
inksby relies on third parties for payments, hosting, and shipping. Their services are governed by their own terms, and we are not responsible for their acts or omissions beyond what the law requires.
Disclaimers
inksby is provided "as is" and "as available." Because monitors and settings vary, printed colors may differ slightly from what you see on screen. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the site will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, inksby and its team will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of inksby. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Some jurisdictions do not allow these limits, so parts of this section may not apply to you.
Indemnification
You agree to defend and indemnify inksby against claims, damages, and costs (including reasonable legal fees) that arise from content you upload, your breach of these Terms, or your violation of any law or third-party right.
Governing law & disputes
These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to conflict-of-laws rules. You agree that disputes will be resolved in the state or federal courts located in Delaware, unless applicable consumer law gives you the right to bring a claim where you live. Nothing here removes rights you cannot waive by law.
Changes to these terms
We may update these Terms as inksby grows. We will post the new version with an updated date, and material changes take effect when we notify you or after a reasonable notice period. Continuing to use inksby after that means you accept the changes.
